B. Fabrègue, member of the Board of Blue Europe, have been published in Larcier Revue du Droit de l’Union Européenne, number 2022/2, with a paper on the relation between Crowdfunding and the simplification of law by the EU.

Abstract

“ […]The Crowdfunding Regulation (2020/1503 ) breaks down national regulations, creating a regime that is extremely favourable to investors and market liquidity. Not integrated into the financial system while imitating certain measures of the latter, the new European crowdfunding puts in place measures proportionate to the stakes. The choice of “non-speciality”, the creation of a legal silo and an exit from the banking and financial regime.   Through a comparative legal study with the options chosen by Swiss and European legislators in the field of crowdfunding, this brief study aims to highlight the whereabouts of this specific regime. “
